Welcome to Badfella. By accessing or using our website at badfellaco.com (the “Site”) and placing an order with us, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully. If you don’t agree, please don’t use the Site.

 

1. About Us

Badfella (“we”, “us”, “our”) is a streetwear brand based in Australia. For all enquiries, contact us at support@badfellaco.com

2. Eligibility

By using the Site or placing an order, you confirm that you are at least 18 years old, or that you have the consent of a parent or legal guardian to use the Site. We reserve the right to refuse service to anyone for any reason at any time.

3. Accounts

You may need to create an account to place an order or access certain features. You’re responsible for keeping your login details confidential and for all activity that happens under your account. Notify us immediately at support@badfellaco.com if you suspect any unauthorised use.

4. Products & Availability

We do our best to display our products accurately, including colours, fits, and details. However, screens differ and slight variations between the on-screen image and the physical product can occur. Product availability is not guaranteed - items may sell out, particularly during drops.

We reserve the right to:

• Limit quantities purchased per customer, per order, or per household
• Discontinue any product at any time
• Correct any errors, inaccuracies, or omissions (including after an order has been placed)

5. Drops, Releases & Limited Editions

Many Badfella pieces are released as limited drops. Once sold out, a piece may not be restocked. Drop release times and details are announced via our website, email list, and social channels. We are not responsible for inability to access the Site during high-traffic drops.

6. Pricing & Payment

All prices are listed in Australian Dollars (AUD) and include GST where applicable. Shipping costs are calculated separately at checkout.

We accept the payment methods displayed at checkout. By placing an order, you authorise us (or our payment processor) to charge the total amount to your selected payment method.

Prices and promotions are subject to change without notice. The price you see at checkout is the price you’ll pay for that order.

7. Order Acceptance

Your order is an offer to buy - it is not accepted until we send you a dispatch confirmation. We reserve the right to refuse or cancel any order at our discretion, including for reasons such as:

• Product unavailability
•  Pricing or product information errors
• Suspected fraudulent activity
• Suspected resale or bot activity
• Issues with payment verification
• If we cancel your order, we’ll refund any payment made.

8. Resale Restrictions

Badfella products are intended for personal use. We reserve the right to limit, cancel, or refuse orders that we reasonably suspect are placed for the purpose of resale, by bots, or by automated means, including orders to the same address, payment method, or IP across multiple accounts.

9. Shipping & Returns

Shipping is governed by our Shipping & Delivery Policy and returns by our Returns & Refunds Policy, both available on our Site. Those policies form part of these Terms.

10. Intellectual Property

All content on the Site - including the Badfella name, logo, graphics, designs, product imagery, copy, and code - is owned by or licensed to Badfella and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, or use any of this content for commercial purposes without our prior written permission. This includes:

• Reselling or reproducing Badfella designs
• Using our logo or branding on third-party products
• Scraping or republishing Site content

11. User Content

If you submit any content to us (reviews, photos, tagged social posts, etc.), you grant Badfella a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, and display that content for marketing and promotional purposes, with credit where appropriate.

You agree that any content you submit:

• Is your own original work or you have permission to share it
• Does not infringe anyone’s rights
• Is not unlawful, defamatory, offensive, or misleading

We reserve the right to remove any user content at our discretion.

12. Prohibited Use

You agree not to use the Site to:

• Violate any law or regulation
•  Infringe our or anyone else’s intellectual property or privacy rights
• Transmit viruses, malware, or any harmful code
• Use bots, scrapers, or automated tools to access the Site or purchase products
• Misrepresent your identity or impersonate anyone
• Interfere with the security or proper functioning of the Site

We may terminate your access if you breach these Terms.

13. Disclaimer

The Site and our products are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties, express or implied, about the Site or its content, including its accuracy, reliability, or availability.

Nothing in these Terms limits or excludes any guarantees, warranties, or rights you have under the Australian Consumer Law that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by law, Badfella, its directors, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products, including loss of profits, data, or goodwill.

Where our liability cannot lawfully be excluded, it is limited (at our option) to:

• Replacing the product, or
• Refunding the price paid for the product

15. Indemnity

You agree to indemnify and hold Badfella harmless from any claim, damages, loss, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

16. Third-Party Links

The Site may contain links to third-party websites (e.g. payment providers, social media). We’re not responsible for the content, policies, or practices of those websites.

17. Privacy

Your personal information is handled in accordance with our Privacy Policy, available on our Site.

18. Changes to These Terms

We may update these Terms from time to time. The most recent version will always be available on the Site, and the “last updated” date below will be revised. Continued use of the Site after changes means you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
